what keeps happening is the plaintiffs lawyer keeps filing documents to reinstate the note, even though it was dismissed in federal bankruptcy court.
The lawyer I originally had a free consultation with said it would cost us big time to hire him, so I'm fighting it on my own.
My latest filing requests sanctions against the other party for "willfully misleading the court"
Here in St Lucie County Fl, the judge passed an emergency ruling that all banks filing foreclosures, must agree to manditory mediation, and send someone with the authority to make a decision at the mediation, and the new mortgage papers. All parties will then try to thrash out a compremise. I have still to hear if anyone has gotten a new loan.
The best advice I got was fight them over the reinstallation of the note, as accepting it makes us libel for the debt.
I will try to keep you informed of what happens, but everyone I know here in the same situation are doing Chapter 7 and including the mortgage.
Does anyone know the legal term for a foreclosure without the note, I'm having a hell of a time trying to find it.
